Terms of Service - ConstructCraft Referral Program

Welcome to the ConstructCraft Referral Program ("Program"). These Terms of Service ("Terms") govern your participation as a referrer and the benefits provided to referred clients for custom home builds. By submitting a referral, you agree to these Terms. Please read them carefully.

1. Program Overview

ConstructCraft, a Utah-based custom home builder, offers this Program to encourage referrals of potential clients seeking custom home construction. Referrers may earn compensation, and referred clients may receive a credit toward premium upgrades, based on the contract value of the signed build contract.

2. Eligibility

  • Referrers: Participation is open to individuals or entities 18 years or older residing or operating within our service area (Utah counties served by ConstructCraft, to be specified in marketing materials). Professional referrers (e.g., Realtors, architects, brokers) must comply with applicable licensing and ethical standards.
  • Referred Clients: Must be individuals or entities seeking custom home builds, not affiliated with the referrer, and willing to sign a build contract with ConstructCraft.

3. Referral Process

  • Submit referrals via our online form at [insert URL] with your contact information and the referred client’s details.
  • Referrers may be required to provide verifiable leads (e.g., client interest confirmed via email or consultation) as part of a Marketing Services Agreement (MSA) with ConstructCraft, where applicable.
  • Compensation and credits are contingent upon a fully executed build contract and are payable only after the referred client signs and commences construction.

4. Rewards Structure

Compensation is based on the contract value of the signed build contract, earned via MSA services:

  • $300,000–$500,000 Contract Value: $2,000 Compensation + $2,000 Credit
  • $500,001–$750,000 Contract Value: $3,500 Compensation + $3,500 Credit
  • $750,001–$1,000,000 Contract Value: $5,000 Compensation + $5,000 Credit
  • $1,000,001+ Contract Value: $7,500 Compensation + $7,500 Credit

Small Print: Compensation is payable only after a signed contract and commencement of the custom home build, earned through MSA services. Disclosure to clients is required for all referrers. Offer void where prohibited; subject to change or cancellation without prior notice. Not a settlement service inducement; all claims are subject to verification. Participants must be 18+ and reside in our service area. Referrers are solely responsible for ensuring compliance with their legal, licensing, or professional restrictions; ConstructCraft is not liable for such obligations. 5. Client Credit

Referred clients receive a credit toward premium upgrades (e.g., custom finishes, smart features) equal to the referrer’s compensation, applicable upon signing the build contract. Credits are non-transferable, non-cash, and expire if construction does not commence within 12 months.

6. Earning and Payment

  • Compensation is paid to the referrer within 60 days of contract commencement, subject to IRS Form 1099 reporting if over $600 annually. Professional referrers (e.g., Realtors) must receive payments through their business entity or brokerage per applicable laws.
  • Credits are applied at the client’s discretion during the build process, subject to availability and contract terms.
  • Compensation and credits are void if the referral is fraudulent, duplicated, or fails to result in a signed contract.

7. Disclosure Requirements

  • Referrers must disclose the compensation to referred clients in writing (e.g., “I may earn up to $7,500 for referring you”) before any referral is made, complying with FTC guidelines.
  • ConstructCraft reserves the right to request proof of disclosure.

8. Marketing Services Agreement (MSA) (Optional)

  • For professional referrers (e.g., Realtors, architects, brokers), participation may require signing an MSA outlining services (e.g., lead qualification, client education) provided, compensating fair market value for effort, not referrals.
  • MSAs must be approved by ConstructCraft and, where applicable, the referrer’s business or brokerage.

9. Limitations and Disclaimers

  • This Program is not an endorsement or guarantee of services. All claims (e.g., compensation eligibility) are subject to verification.
  • Offer void where prohibited by law, including RESPA (12 U.S.C. § 2607) restrictions on settlement service inducements.
  • ConstructCraft may modify or terminate the Program with notice; existing referrals under signed MSAs or valid submissions remain eligible if contracts are executed.

10. Tax and Legal Compliance

  • Referrers are responsible for reporting compensation as income. ConstructCraft will issue 1099s as required.
  • Clients should consult tax advisors regarding credit implications.
  • This Program complies with Utah and federal regulations, including real estate licensing laws where applicable. Referrers are responsible for ensuring their participation adheres to their own legal and licensing obligations, and ConstructCraft assumes no liability for such compliance.
